Three cases resolved in the last year illustrate our expertise:-

 
Case Study 1 - Cutting Edge Care and Accommodation Arguments

The claimant had suffered significant brain injuries (there was no issue on liability). The significant issues were the care and accommodation claims and the extent to which the claimant could pursue these against the defendant or had to rely upon the local authority. The case would have dealt with an extension of the principles laid down by the Court of Appeal in the case of Sowden -v- Lodge. The claim settled prior to trial and represented a saving of approximately £3 million on pleaded value.

 

Case Study 2 - Rehabilitation

Another significant brain injury claim, this time a motorcyclist.  Early and intensive rehabilitation was arranged which substantially improved the claimant's residual functioning and quality of life and as a consequence of this there was a saving of approximately £1 m to our clients.

 

Case Study 3 - The Full Range of Arguments on Liability, Contributory Negligence and Causation

Pedestrian lying drunk in the road subsequently hit by taxi. Sustained multiple injuries including traumatic brain injury. Issues on every point including difficult issues of liability, contributory negligence and causation (claimant had pre-existing drink and drug habit) and quantum. Settled with court approval at a saving of approximately £1m to our clients.
