I know where my boundary is but my neighbour doesn’t, he has stolen some of my land!

Most boundaries have not been registered with the Land Registry and unfortunately their plans are of insufficient scale to determine matters. Each matter needs to be looked at individually and usually needs a report from an expert surveyor. Boundaries can be determined by the Courts or the Land Registry Adjudicator.  We can assist with applications to both.

A boundary dispute can reduce your ability to sell your property as it will need to be disclosed to any prospective purchaser.

Restrictive covenants

We need to check that the covenant is relevant, registered and whether you can benefit from it or ignore it.

There are cracks in my property and roots in the drains!

We need to find out the cause of the damage and who is responsible. Overhanging branches can be cut but you need to be sure that it is only to the line of the boundary and you must not fatally damage any trees. We can advise you on the application procedure to your local authority to reduce the height of trees. 

Who has right of way over my land? My neighbours have blocked my right of way! Can I park on my right of way?

We need to look at who has the property rights, how they have been granted and how they have been used. If your access has been blocked you may need to take urgent Court action. Unfortunately a right of access does not usually mean a right to park.

I live next door to the neighbours from hell. I’ve been flooded out by my neighbours.

Party Wall etc Act 1996 -

If your neighbour carries out building works within 3 metres of your property or 6 metres of your foundations you may have rights under this Act. You may be able to appoint a surveyor to protect your interests at your neighbour’s expense. However problems can arise if the procedure is not followed or finished. So we advise you not to sign anything until you have spoken to a surveyor or lawyer or both!
