Tenant is in rent arrears, what should I do?

If a tenant is in two or more months rent arrears, we can issue a NOSP which is a 2-week plus postage notice. Once expired we can issue Court proceedings.

There are no rent arrears how do I get vacant possession?

 

As long as the tenancy was granted after February 1997, a Section 21 Notice may be served - this is a two months' notice. Whether it can be served in or out of your fixed term depends upon your tenancy agreement.
The possession procedure is different if the tenant is not an individual or if the rent is more than £25,000.00 p.a.

 

Can I just change the locks?

A landlord can only take possession once he has obtained a Possession Order from the County Court. Once the Possession Order has expired, if the tenant does not vacate you must apply for a County Court Bailiff's appointment.

 

How long until I get possession?

This largely depends upon the individual Court but after the relevant Notice has expired about 8 to 10 weeks.

 

Tenant has vacated with rent arrears. How do I get my money?

We can pursue former tenants for any rent arrears and charges for dilapidations owed to you by issuing County Court proceedings and obtaining a Judgment.

 

What happens if I do not know where my tenants have moved to?

We can trace and obtain forwarding addresses and employment details through our qualified tracing agents.

 

How much do possession proceedings cost?

Can I get these costs back from the tenant?

Most tenancy agreements provide for the costs to be paid by the tenant of there has been a breach of the Agreement. However, costs are at the discretion of the Judge.
