Rogers - v - Methyr Tydfil Borough Council - Another Court of Appeal Success for colemans-ctts

We acted for two major After the Event Insurers to represent their interests by intervening into a Court of Appeal Test Case on After the Event Insurance (ATE) that will have a significant effect on the ATE market.

The Court of Appeal endorsed the position taken by our clients, upholding the concept of staged premiums as a legitimate method of setting insurance premiums. The Court also accepted that a substantial final stage premium was proportionate and necessary in the circumstances of the case. Further guidance was given on the use of comparative data and the approach to be taken to the evidence to be provided when ATE premiums are challenged.
