One month to go! Are you licensed for the new points-based system?
Even if you your current business plans do not include employing a migrant worker, but it is something that you may decide to do in the future, you must be licensed with the UK Border Agency as a sponsor in order to employ a migrant worker.
In the biggest shake up of immigration control for a very long time, the Government have introduced a points-based system for controlling migrant workers wishing to work in the UK. The skilled and temporary worker tiers of the points-based system are due to be launched at the end of November, but in order to employ a migrant worker in either category your business must have applied for a Licence by 1st October.
Essentially, if you wish to become a sponsor, even if not in the immediate future, you must become licensed. You will need to visit the UK Border website at www.ind.homeoffice.gov.uk to make an online application.
However, you should contact colemans-ctts Solicitors Head of Immigration, Lorna Valcin (lorna.valcin@colemans-ctts.co.uk) for any further advice, including the civil and criminal penalties that might be enforced against you if you employ an illegal migrant worker or for more information on the points-based system.
