Industrial Deafness

Are you suffering from hearing loss or noises in your ears that you think may have been caused by exposure to loud noise at work?

Some employers continue to disregard the factors responsible for industrial deafness, putting workers at risk. These factors include:

  • a lack of effective ear protection,
  • unacceptable levels of noise
  • failing to provide warning notices of excessive noise.

Exposure to an excessive amount of noise can cause permanent and irreversible ear damage, leading to noise induced hearing loss or tinnitus, a common symptom where there is an intrusive ringing or buzzing which can have a detrimental impact on sleep.

If you have sustained hearing loss due to your employer failing to provide adequate warning or protection in a noisy environment, then you may be able to pursue a claim against your employer or previous employers.

Colemans-ctts can help you make an industrial deafness compensation claim. We have expert solicitors in offices in Kingston upon-Thames and in Manchester. Call the Kingston office on 0208 296 9966 or Manchester on 0161 876 2500 to discuss your potential case or fill in our online claim form here to get in touch online.

Noise at work safety measures and employer responsibilities

Even if noise was an expected part of the job, this does not mean that your employer did not have to ensure the correct safety measures were in place.

Employers have had a duty to protect their employers from the risk of exposure to excessive noise since 1963. The employer must take action where the levels are above eighty decibels on average.

What are the time limits for a claim?

The important issue is to ensure you take legal advice on a potential deafness claim within three years of receiving a diagnosis of occupational hearing loss.

You do not need to have had a previous hearing test to make a claim for compensation, although it does help us to consider your claim if you have.

What if the company has ceased trading?

It may still be possible to pursue a deafness compensation claim against a former employer for industrial deafness or ear damage, even if the company has ceased trading.
