Employment Blog: Employment Tribunal Pays Out £103,000 to Sacked Hospital Lawyer

Mid Staffordshire NHS Trust has admitted that it “wrongfully and unfairly dismissed” the former Head of Legal Services, Kate Levy, after being ordered to compensate her with over £100,000 by an employment tribunal.
Ms Levy had asked a doctor to suppress the details of a patient’s death in 2006 to avoid further distress to the family and avoid any negative public criticism. She was sacked in June 2010 and lost a subsequent internal appeal.
However, Ms Levy had always maintained that her actions were appropriate with her role as a lawyer for the hospital.
Mid Staffordshire NHS Trust released a statement explaining their new position: "Following legal advice we received from our barrister at the start of the tribunal we conceded that Ms Levy was wrongfully and unfairly dismissed."
Had they stated the responsibilities of Ms Levy to preclude this type of action in her contract of employment it is difficult to see how they would have lost the tribunal and been forced to make this large payment.
