Employment Blog: Will Doctor’s Employment Tribunal Award Affect Patient Care?

Following the record award of nearly £4.5m to Dr Eva Michalak last month, a council watchdog has asked for assurances that patient care will not be compromised at Mid Yorkshire Hopsitals Trust because of damages to their finances as a result of the pay-out.
Dr Michalak had been awarded the sum following years of bullying and sexual and racial discrimination which culminated in unfair dismissal.
The watchdog reported: “Notwithstanding the public apology and the commitment to ensure there is no repetition, the committee is concerned in relation to the reputational damage sustained by the trust and the need to restore public confidence.
“In addition, there is some concern relating to a substantial compensation pay out at a time of financial pressure within the trust and the committee would seek reassurances that any payment would not compromise the provision of high quality patient care.”
The concerns raised are further evidence of exactly how losing an employment tribunal can negatively affect the financial equilibrium of an organisation and impact on quality of service or product, even at an organisation as large as Mid Yorkshire Hospitals Trust.
