Employment Blog: Workers win £250,000 After Employment Tribunal Victory

Monday 20th Feb 2012

Fourteen Polish workers have been awarded more than £250,000 from their sub-contractor, Darmar, for their work at Severn Power Station in Uskmouth, Newport after an employment tribunal found they had been underpaid for overtime work.

However, the workers may not receive the pay-out – approximately £18,000 each – as the contractor has since left the UK.  Jeff Beck, of the GMB, explained: "The order is enforceable in the UK but the employer has now closed their offices... and has left the UK."

Beck said that they would be pursuing the case, however: "We have an officer in Brussels and we will be raising this in the European Parliament to see if there are any avenues that can be explored."

While the men were paid incorrect sums for overtime work, they were also denied seven months’ worth of holiday payments and were deducted a day’s lodging allowance a week.

Beck went on to say that there were “many industries where these people are coming into the UK to work and being totally exploited by unscrupulous employers."
