Fixed Fee or “No Collect-No Fee”
In most cases we are able to work on a “no collect - no fee” basis because we expect to recover all legal costs and interest from Leaseholders because most leases include charging provisions enabling recovery of legal costs.
What accounts qualify for the “No Win – No Fee” Service:
In most cases we expect to recover our fees directly from the defaulting Leaseholder, providing the account meets the following criteria:
- The freehold property is registered in England & Wales & mortgaged
- The Lease requires the Tenant to pay professional costs including those of recovery
- The Lease has provision for forfeiture
- The debt is not genuinely disputed
Our costs are generally fixed price and pre-agreed with our clients so that the cost of each stage of the process is fixed.
Cases Not Fulfilling Criteria
The majority of cases will fulfil the criteria. However if some do not, then we will offer to undertake the work for you on an alternative commission based or fixed price service.
How does the service work?
Our service is national and strategies are flexible to suit clients’ needs.
Simply upload schedules of outstanding accounts to us or email/fax us details and we will start work immediately.
Our service includes:
- Initial Demand letters
- Telephone collection where necessary
- Preparing and issuing County Court proceedings
- Obtaining Judgment
- Liaising & corresponding with the Debtor’s Mortgage Company
- Preparing and issuing s.146 notices
- Preparing & issuing Forfeiture proceedings
Bulk Account Handling
As well as handling individual accounts, we can also handle bulk account collections and act as part of a credit control process, handling collections and enquiries and liaising with property mangers.
Our service covers every stage of the process from demand letter to litigation, judgment and forfeiture if necessary.
Disputes /Complex/ Defended Cases or Leasehold Valuation Tribunal Applications
We are experienced in handling disputes and LVT Applications and will advise and agree with you appropriate action to be taken and the costs involved.
Disputed or complex cases are charged on a time basis. We will always try to ensure our charges are proportional to the value of your claim.
Our fees are based on guidelines given by the Courts and we aim to recover these from the Leaseholder debtors where possible.
