Your Redundancy Rights
Redundancy is caused when an employer needs to reduce its workforce, with reasons including:
- The business closing down or moving
- Cost-cutting by reducing the size of the workforce
- The job you were hired for no longer existing
- New technology making your job unnecessary
- Reallocation or reorganisation of work
If you are being made redundant, you have a number of rights by law, such as:
- The right to meaningful and genuine consultation, about why you have been selected for redundancy and alternatives to redundancy. You may be able to make a claim if you think your employer did not begin the consultation early enough, ended the consultation early or didn't consult properly.
- A termination notice, which can only be issued after the consultation and states the date of your last day of employment.
The employer also has a duty to notify the government within 90 days of proposing redundancy if 20 or more redundancies are being made. The notification must take place at least 30 days before anyone is dismissed.
